These Terms of Service ("Terms") govern your use of the Weldingmen Offroad website and any purchases you make from us. By using our site, requesting a quote or placing an order, you accept these Terms and our Privacy Policy.

1. Definitions

  • "We", "us", "our": ICARUC PTY LTD t/a Weldingmen Offroad.
  • "You", "your": the person browsing our website, requesting a quote or placing an order.
  • "Order": a purchase order placed via our website, by email, or by phone.
  • "Goods": the products we sell, including engineered trays, canopies, accessories and parts.
  • "ACL": the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

2. Orders and acceptance

An order placed on our website constitutes an offer to buy. We may accept or decline any order. Your order is accepted only when we send you an order confirmation by email. For competition build quotes, the quote becomes a binding order once you confirm acceptance in writing and we receive the required deposit.

3. Pricing and payment

All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice but the price applicable to your order is the price displayed when you place it. We reserve the right to correct pricing errors and to cancel any order where a price was clearly wrong.

Payment is required before goods are dispatched (for stocked items) or before production begins (for tray and canopy builds, via deposit then balance on completion).

4. Tray and canopy builds

Spec'd ute trays, canopies and fit-out components are made to order. Once production has started:

  • The order is non-cancellable except for a manufacturing defect or our breach;
  • The order is non-returnable for change-of-mind reasons (this does not affect your rights under the ACL);
  • Estimated lead times are estimates, not guarantees. We work hard to meet them and will keep you informed of any change.

You agree to provide accurate vehicle information and build specifications. We rely on what you tell us to spec your build and we are not liable for fitment or capability issues arising from inaccurate information you provided.

5. Stocked accessories

Stocked accessories may be returned within 30 days of delivery for a refund of the purchase price (excluding return freight), subject to the conditions in our Shipping & Returns policy. This is in addition to your rights under the ACL.

6. Delivery and risk

We arrange delivery via established freight providers. Estimated delivery times are estimates only. Risk in the goods passes to you on delivery; title passes when we receive payment in full.

7. Warranties

We warrant our competition trays and canopies against structural defects for 3 years from delivery, and our stocked accessories for 12 months, subject to normal use, proper installation and reasonable maintenance. Our welds are warranted for the life of the vehicle. Our warranty does not cover wear and tear, misuse, accident damage, modification, or installation by an unqualified third party.

This warranty is in addition to, and does not limit, your rights and remedies under the ACL.

8. Consumer guarantees and limitation of liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

To the maximum extent permitted by law, and subject to the consumer guarantees that cannot be excluded:

  • Our total liability arising out of or in connection with the goods or these Terms is limited to the price you paid for the affected goods;
  • We are not liable for indirect, consequential, incidental, special or punitive losses, including loss of profit, loss of opportunity, or loss of data;
  • We are not liable for any failure or delay caused by events beyond our reasonable control (force majeure).

9. Intellectual property

All content on our site - including text, photography, designs, product specifications, logos, and code - is owned by us or our licensors and is protected by Australian and international intellectual-property laws. You may not reproduce, distribute, modify or use it commercially without our written permission.

10. Acceptable use

You agree not to use our site to: (a) violate any law; (b) infringe anyone's rights; (c) post or transmit any unlawful, defamatory, obscene, harassing or otherwise objectionable material; (d) interfere with the security or operation of the site; or (e) collect any user data without their consent.

11. Linked sites

Our site may link to third-party websites. We are not responsible for the content or practices of those sites.

12. Privacy

Your privacy is governed by our Privacy Policy, which forms part of these Terms.

13. Termination

We may suspend or terminate your access to the site at our discretion if you breach these Terms. Termination does not affect any rights or remedies that accrued before termination.

14. Governing law and jurisdiction

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising under or in connection with these Terms.

15. Variation

We may amend these Terms from time to time. The "Last updated" date will reflect the most recent change. Continued use of the site after a change constitutes acceptance of the amended Terms.

16. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force.

17. Entire agreement

These Terms, together with our Privacy Policy and any order confirmation we issue, constitute the entire agreement between us and supersede any prior agreement.
